1) Terms and Conditions

These terms apply to all visitors, users, and others who access or use our products and services. Where it says “you” or “your” in this document, it refers to you or anyone acting on your behalf. Where it says “we,” “us,” or “our,” it refers to Mindfit AS.

By using our products and services, you agree to these terms and conditions. If you do not agree, please do not use our products and services.

1.1) Changes to our terms

Mindfit reserves the right to change or update these terms and policies. The changes will take effect when published on this page. Continued use of the service will be considered acceptance of the updated terms.

1.2) Privacy

Mindfit does not collect personal information from you as a user of the Mindfit app.

Your data is only stored on your mobile phone. We have no access to who you are as a user of the application, and you are not required to register in order to use our services.

See our Privacy Policy for details on how we collect and use information. By using our products and services, you agree that your use is subject to our Privacy Policy.

2) Pricing, purchases and payments

Mindfit app can be purchased and downloaded via the App Store and Google Play (hereafter referred to as “app distributor”). Prices for the different subscriptions are also listed on the download page of the app distributor.

You can purchase Mindfit app through a monthly, quarterly and/or annual subscription.

All payments are processed and handled by the app distributor. You manage your purchases there and accept their terms and conditions before purchasing Mindfit app.

2.1) Purchases and subscriptions

You can try Mindfit app free of charge for 7 days.

After that, you can purchase Mindfit through a monthly, quarterly, or annual subscription.

If you do not cancel your subscription before the trial period ends, you will automatically be charged via App Store or Google Play.

You will have access to Mindfit through a paid subscription that provides access to all content. You will continue to have access as long as your subscription is active.

Subscriptions are automatically renewed until you cancel.

All amounts are billed and charged:

  • For monthly, quarterly, or yearly subscriptions, at the beginning of the subscription period.
  • Each subscription is automatically renewed for an additional period of the same length as the expiring period, until you cancel using the payment details you provided.
  • You must cancel your subscription before it renews to avoid being charged for the next subscription period.

2.2) Cancelling subscriptions

You can cancel your subscription at any time by turning off renewal directly with the app distributor.

  • You will not receive a refund for amounts already paid for the current subscription period.
  • You will continue to receive the services ordered until the end of the current subscription period.

2.2.1) When Mindfit may terminate the agreement

Mindfit may terminate the agreement if there is a valid reason, including but not limited to substantial changes to or discontinuation of the service.

2.2.2) Refunds

Refunds for purchases and subscriptions are handled by the app distributor (App Store or Google Play) according to their policies. Mindfit cannot issue refunds directly.

You will not receive a refund for amounts already paid for the current subscription period.

  • On Google Play, in some cases it may be possible to request a refund within 48 hours after purchase.
  • On the App Store, refund requests are managed via Apple’s “Report a Problem” system.

We recommend contacting the app distributor directly if you wish to request a refund.

2.3) Changes in prices

Mindfit reserves the right to change subscription prices at any time. Notifications of price changes are sent by the app distributor (App Store or Google Play) before such changes take effect.

Price changes will not apply retroactively and will only apply to subscription renewals after the new prices have been communicated to you. If you do not agree to the changes, you can choose not to renew your subscription. You must cancel your subscription yourself with your app distributor (App Store or Google Play).

2.4) Future functionality and updates

You agree that your purchases are not dependent on the delivery of future functionality or features. Mindfit has the right to change our solutions and the terms of use.

These terms are entered into between you and Mindfit, not with the app distributor. Mindfit is solely responsible for the content and future functionality of the app.

Older versions of Mindfit may be phased out over time. The latest version will always be available in the App Store or Google Play.

3) Disclaimer of liability

Mindfit’s services and all products are provided “as is.” You understand and agree that the services are provided to you “as is” and “as available,” without any warranties.

Use of our services and related content is at your own risk. Mindfit shall not be held liable for any direct or indirect damages arising from the use of our services. This does not apply if Mindfit has caused damage through gross negligence or willful misconduct. In such cases, liability is limited to the amount you have paid Mindfit for the use of the service.

3.1) We are not a medical provider

You understand and agree that our products and services are not intended as medical treatment, diagnosis, or a substitute for professional healthcare. Mindfit makes no guarantees that the use of the app provides health benefits.

Do not use the services while driving or performing other tasks that require attention and concentration. You understand and agree that you are solely responsible for your use of the services.

Purpose: Mindfit is intended as a self-help tool
Mindfit is a preventive self-help app focusing on mental training. Mindfit app is not a replacement for therapy with a psychologist. The app is designed as a guide and motivator to help you make the changes you want.

The core functionality of Mindfit is to challenge negative thought patterns and identify positive alternative thoughts by journaling positive experiences and memories. Mindfit provides functionality such as mood tracking, journaling, related content, and mental coping techniques that may help reduce everyday stress.

The app is inspired by well-known therapeutic methods such as cognitive therapy, positive psychology, self-leadership, and EMDR.

3.2) Product performance and availability

Although we aim to provide you with the best possible service and keep our products updated and accurate, we make no guarantees that the product is error-free or will meet your expectations or requirements.

Mindfit AS shall not be held liable for service interruptions caused by circumstances beyond our control. These include, but are not limited to, technical problems, infrastructure failure, sabotage, and force majeure.

4) Intellectual property rights

The service and its original content, design, features, and functionality are and will remain the exclusive property of Mindfit AS and its licensors. The service is protected by copyright, trademark, and other laws in both Norway and other countries.

Our trademarks may not be used in connection with any products or services without written consent from Mindfit AS.

5) Links to other websites

Our service may contain links to third-party websites or services that are not owned or controlled by Mindfit AS. If you click on a third-party link, you will be directed to that website.

Mindfit AS has no control over, and assumes no responsibility for, the content, privacy policies, or practices of third-party websites or services. You agree that Mindfit AS shall not be held directly or indirectly liable for any damage or loss alleged to be caused in connection with the use of or reliance on such content, goods, or services.

We strongly recommend that you read the terms and privacy policies of any third-party websites or services you visit.

6) Governing law

These terms shall be governed by and interpreted in accordance with Norwegian law.
